Personal Injury

Personal Injuries can arise from a variety of circumstances including vehicle collisions, dangerous conditions on property, defective products or professional negligence.

Business Litigation

Most business litigation involves America’s smaller companies, not the giant corporations you see in the news. Make no mistake, however: even smaller companies deal in millions of dollars and the stakes are high.

Wrongful Death

Wrongful death cases present unique issues. Not only does Georiga have specific rules about who can bring such a case, but family members are trying to handle a serious legal matter while grieving over a huge loss in their lives.

Mediation

Mediation is a process utilized by all Courts, both State and Federal, in Georgia.  It helps get cases settled more quickly and cheaply than litigation, which can be time-consuming and expensive.

Employment Discrimination

Employment law is a complicated and ever-changing area of the law. An attorney who fully understands the intricacies of the law can help you obtain fair compensation for the wrong you endured.

Social Security Disability

A Social Security Disability case is very different from other legal matters. The laws, regulations and procedures for Social Security Disability and SSI claims are extremely technical, and require detailed legal knowledge.

Workers Compensation

An injury at work can be devastating. It may be difficult to pay medical bills and support family members that depend on you. Dealing with an employer and its insurance company can be overwhelming.

General Legal

Although we have an emphasis in Personal Injuries, Job Injuries, Disability claims and Corporation/Business matters, our practice is general and we frequently handle other legal matters as needed

R. Leslie Waycaster, Jr.

Mr. Waycaster has been practicing law in Dalton, Georgia since July, 1980. He attended undergraduate school at Georgia State University and law school at the University of Georgia. He is admitted to practice in all Georgia trial and appellate courts. He is also admitted to practice in Federal Court in the Northern District of Georgia, Eleventh and Fourth Circuit Courts of Appeals and the United States Supreme Court.

Mr. Waycaster has an AV rating with Martindale Hubbell, the preeminent lawyer rating service in the United States. An “AV” rating is the highest rating in both professional ability and ethics. Mr. Waycaster has served as the President of the Conasauga Judicial Circuit Bar Association, as well as a Regional Vice-President for the Georgia Trial Lawyers Association. He also served on the State Bar of Georgia Board of Governors.

Mr. Waycaster focuses his practice in the areas of personal injury (vehicle collisions, defective products, professional malpractice and slip and fall), business litigation and mediation. He has tried approximately 100 jury trials and handled cases in excess of twenty-five (25) Georgia counties. He has also tried cases in Federal Court in Rome, Atlanta and Gainesville, Georgia.

While Mr. Waycaster has represented clients in hundreds of personal injury cases, his experience has also included trials involving breach of contract, fraud and violation of state and federal racketeering statutes and violations of the federal wiretapping statute. His verdict in a medical malpractice case in Madison County, Georgia was the highest verdict in that county at that time. He has also assisted other attorneys in class actions involving the failure to pay overtime wages and another involving the failure to properly compensate poultry farmers.

“I have been fortunate to represent a lot of good people who had bad things happen to them. We have had cases which resulted in awards of large sums of money, but we also take cases of smaller value, if we think we can help someone. If we cannot help that person we try to find someone who can.”      Leslie Waycaster

When not practicing law, Mr. Waycaster enjoys traveling, riding just about anywhere in some kind of boat, and spoiling his granddaughter.

Timothy H. Allred (of counsel)

Mr. Allred was admitted to the State Bar of GA in 1982 and served as a Workers Compensation attorney for several of the largest employers in Northwest GA (including Shaw Industries, Mohawk Industires, J&J Industries, K-Mart, Liberty Mutual Ins. Co., State Farm Ins. Co., and Hartford Ins. Co.) from then until 2001.

He litigated hundreds of Workers Compensation cases at all levels from the State Board of Workers Compensation to the GA Court of Appeals. Since that time he has focused his legal practice on representing people injured on the job and applying for Social Security Disability benefits.

Commanding the Martindale-Hubbell rating of BV, “Distinguished”, Mr. Allred has taught classes on Banking Law and Education Law to professionals in those fields, and served as the School Board Attorney for Dalton Public Schools for over 15 years.

His commitment to bettering the lives of his clients in Northwest GA and beyond, both through representation and community service, is of utmost importance to him.

"THANK YOU" Leslie for being by my side every step of the way!!!

I was represented by Leslie Waycaster in 2010 after my husband’s accident. I can highly recommend him as an attorney. Leslie is not only very knowledgeable and very good at what he does and in my opinion, one of the best attorneys in Dalton but he is also very caring and compassionate about his clients. I was pleased and honestly surprised on how much I was updated throughout the whole process.

It was nice to have an attorney that cared so much and felt my pain.

I’m not sure if Leslie can see this or not but if you can I would like to say “THANK YOU” Leslie for being by my side every step of the way!!!

Better Than I Could Asked For.

Mr. Waycaster did an outstanding job with my case. I was in an auto accident and my case was with the insurance company. Throughout my case, Mr. Waycaster kept me updated on a weekly basis. He was very knowledgeable and if there was anything he was unsure of, he did whatever it took to find the information needed. He always consulted me before any decision was made in my case. I trust and will use Mr. Waycaster on any kind of future case that I may have.

Just what I was looking for...

I’m a small business owner and went to Mr. Waycaster to incorporate my business. I chose to do business with Mr. Waycaster because he seemed genuinely interested in me as a client. He took the time to ask questions about my business so he could best advise me. It wasn’t about just doing the job at hand, which was my impression from other attorneys, but about building client relationships. That was important to me. I will continue to do business with Mr. Waycaster as my business grows and will definitely recommend him to others.
